Welcome to Bublly. These Terms of Service ("Terms") govern your access to and use of Bublly's website, products, and services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

1. Acceptance of Terms

By creating an account, accessing, or using any part of Bublly, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using Bublly on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

2. Description of Service

Bublly is an all-in-one business platform designed for small and medium-sized businesses. Our Service includes:

• Unified Inbox: Manage customer communications across multiple channels in one place
• AI Assistant: AI-powered customer support and smart automation features
• Ticket Management: Organize and track customer support requests efficiently
• CRM & Contacts: Manage customer relationships and contact information
• Knowledge Base: Create and manage self-service documentation for customers
• Workflow Automation: Automate repetitive tasks and processes
• Messaging & Campaigns: Integration with WhatsApp Business API allowing users to send chat messages, approved message templates, and campaigns to their customers.

3. User Accounts & Registration

To access certain features of our Service, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information to keep it accurate
• Keep your password secure and confidential and not share it with others
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

4. Acceptable Use Policy

You agree to use our Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Violate any applicable laws, regulations, or third-party rights
• Send spam, unsolicited communications, or harass other users
• Upload malicious code, viruses, or any harmful content
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use the Service for any fraudulent or deceptive purposes

• Send WhatsApp messages without valid customer opt-in, or in violation of WhatsApp Business policies.
• Use WhatsApp messaging features to send prohibited, misleading, or abusive content as defined under WhatsApp Business policies.

The Service and its original content, features, and functionality are owned by Bublly and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written consent.

You retain ownership of any content you submit, post, or display on or through the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content solely for the purpose of providing and improving the Service.

6. User Content & Data

You are responsible for any data or content you upload, store, or transmit through our Service ("User Content"). You represent and warrant that:

• You own or have the necessary rights to use and share your User Content
• Your User Content does not violate any third-party rights
• Your use of the Service complies with all applicable data protection laws

We do not claim ownership of your User Content. However, we may access, preserve, or disclose your User Content if required by law or if we believe it is necessary to protect our rights or the safety of our users.

Bublly provides tools that allow users to send WhatsApp messages, including chat replies, message templates, and campaign-based communications. Bublly does not initiate, compose, or control WhatsApp messages. All messages are created and sent solely by users of the Service. Users are solely responsible for the content, timing, recipients, message templates, and campaigns sent using the Service, including compliance with applicable laws, regulations, and WhatsApp Business policies. Users are responsible for obtaining and maintaining valid customer opt-ins and consents before sending any WhatsApp messages, including templates and campaign messages. Bublly does not verify or manage customer consent on behalf of users. Bublly processes messaging data only to provide the Service and does not sell, rent, or misuse WhatsApp message content or customer contact information. Message templates used through the Service are subject to WhatsApp approval and platform-specific requirements.

7. Third-Party Services & Integrations

Our Service may integrate with or contain links to third-party websites, services, or applications. We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is at your own risk and subject to the terms and conditions of those services.

7.1 WhatsApp Business API Integration

WhatsApp is a trademark of Meta Platforms, Inc. Bublly is an independent product and is not affiliated with, endorsed by, or sponsored by Meta Platforms, Inc. or WhatsApp.

8. Payment Terms

Certain features of our Service require payment. By subscribing to a paid plan, you agree to:

• Pay all fees in accordance with the pricing and payment terms presented at the time of purchase
• Provide valid payment information and keep it up to date
• Accept that subscriptions auto-renew unless cancelled before the renewal date

We reserve the right to change our pricing at any time. If we change pricing, we will provide advance notice before the changes take effect. Refunds are handled in accordance with our refund policy available upon request.

9. Termination

You may terminate your account at any time by contacting us or through your account settings. We may terminate or suspend your account immediately, without prior notice, if you breach these Terms or for any other reason at our sole discretion.

Upon termination, your right to use the Service will immediately cease. We may delete your account and associated data after a reasonable period following termination, subject to our data retention policies and legal obligations.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUBLLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

11. Indemnification

You agree to indemnify, defend, and hold harmless Bublly, along with its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or any infringement of the rights of another party.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved through good faith negotiation. If negotiation fails, disputes may be submitted to binding arbitration or the courts of competent jurisdiction.
